INVITATION FOR BIDS (IFB)
Construction of Jakarta Mass Rapid Transit Project (Phase 2) (I)
PROCUREMENT OF
Contract Package CP202: UNDERGROUND SECTION-CIVIL 2
(RE-BIDDING PROCESS)
1. The Government of the Republic of Indonesia represented by its Ministry of Finance received an ODA loan (Loan Agreement No. IP - 578 dated 24 October 2018) from Japan International Cooperation Agency (JICA) for the Contruction of Jakarta Mass Rapid Transit project (Phase 2) (1). The proceeds of this loan include the eligible payments under Contract Packages CP202: Undergound Section-Civil 2 (CP202) & and CP203: Underground Sections-Civil 3 (CP203), comprising of:
• CP202: Undenground Section-Civil 2, comprising of 1134m (approx.) length of twin bored tunnels, 635m (approx.) total length of three (3) underground stations, namely Harmoni, Sawah Besar, and Mangga Besar stations, and together with mechanical and electrical works associated with station building.
• CP203: Underground Section-Civil 3, comprising of 685m (approx.) length of twin bored tunnels, 651m (approx.) length of cut and cover tunnel structure, including two (2) underground stations, namely Glodok and Kota, and together with mechanical and electrical works associated with station building.
The Special Terms for Economic Partnership (STEP) of Japanese ODA Loans and the Operational Rules of STEP (December 2018) published by JICA are applicable.
This Bidding is a re-bid process following the non-receipt of Bids for Contract Packages CP202: Underground Sections-Civil 2 & and CP203: Underground Sections-Civil 3 which were floated on 6th August 2019.
2. Bidding will be conducted through procedures in accordance with the applicable Guidelines for Procurement under Japanese ODA Loans published in April 2012 and is open to Bidders from eligible source countries as defined in Schedule 4, Section 2 of the Loan Agreement between JICA and The Government of the Republic of Indonesia on Eligible Nationality, the excerpts of which read as follows:
(i) The Eligible Nationality of the Supplier(s) shall be the following:
a. Japan in the case of the prime contractor; and
b. All countries and areas in the case of the sub-contractor(s).
(ii) With regard to item 2 (i) above, in case where the prime contractor is a joint venture, such joint venture will be eligible provided that nationality of the lead partner is Japan, that the nationality of the other partners is Japan and/or the Republic of Indonesia and that the total share of work of Japanese partners in the joint venture is more than fifty percent (50%) of the contract amount.
If there are any ambiguities or discrepancies found between the provisions of Schedule 4, Section 2 of the Loan Agreement and the Operational Rules of the STEP (December 2018) published by JICA, the provisions of the Loan Agreement shall prevail.
3. PT. Mass Rapid Transit Jakarta (Perseroda) (MRTJ) as the Employer invites sealed Bids from eligible Bidders for the design, execution and completion of the works under CP202 and CP203.
4. International Competitive Bidding (ICB) will be conducted in accordance with JICA’s “Single-Stage TwoEnvelope Bidding” (Without Prequalification)” Bidding Procedure.
5. Eligible Bidders may bid individually for CP202 or CP203 as well as a combined bid for CP202 and CP203.
It is a precondition for a combined bid that eligible Bidders shall submit the respective bid for CP202 and CP203 in addition to a combined bid. In the event, the prospective Bidder is selected and awarded a combined contract package, it is a precondition for the combined contract package that the price after reduction for CP202 and CP203 should be provided in the Letter of Price Bid as result of efficiency efforts by Bidder on this combined contract package
Bidder(s) who intend to participate in submission of a combined Bid for CP202 and CP203, and after evaluation by the Employer is awarded an individual Bid for either CP202 or CP203, shall not refuse acceptance of the award without the Bid Security being forfeited. In the event that a Bidder withdraws its Bid after a Letter of Acceptance is issued, such Bidder’s Bid Security shall be considered as forfeited.
6. A complete set of the Re-Bidding Documents for CP202 and/or CP203 may be collected at no charge by interested Eligible Bidders between 7 February 2020 and 14 February 2020 (except Weekends and public holidays) during office hours of 09:00 to 12:00 WIB and 13:00 to 15:00 WIB with the submission of a written application to PT Mass Rapid Transit Jakarta (Perseroda) hereinafter referred to as “MRTJ”. Bidder(s) who choose to bid individually for CP202 or CP203 or in a combined Bid for CP202 and CP203 may collect all seven (7) volumes of the Re-Bidding Documents from the Tender Committee (CP202/CP203 are both included in a single set of Re-Bidding Documents). Upon collection of the Re-Bidding Documents, it is a precondition that an Eligible Bidder shall bring along with him/her an authorization letter (signed by an authorized representative of his/her company) and the Bidder’s original company profile and, if necessary, a certified copy of Letter of Award from previous project experience pertaining to item No.7 below.
7. To qualify as an eligible Bidder who may collect the Re-Bidding Documents for Contract Package(s) CP202 and CP203, it is mandatory that the bidder meets the requirement stated in Schedule 4, Section 2 of the Loan Agreement and is a Japanese Company acting as a single entity or a Japanese Company acting as a Lead member of a JV in compliance with The Special Terms for Economic Partnership (STEP) of Japanese ODA Loans and the Operational Rules of STEP published by JICA. It is also a requirement that the Japanese Company acting as a single entity or as a Lead member of the JV has successfully completed a design-build urban railway project within the last 10 years with a minimum value of Nine Billion Japanese Yen [JPY 9,000,000,000] or an amount equivalent thereto in another currency.
A Project Orientation Conference for the re-tender of CP202/203 was held on 6 Jan 2020 at MRTJ’s Office to give prospective Bidders an overview of the Project in respect of the applicable Contract Packages and a further Pre-Bid Conference may be held by MRTJ at a suitable time and date if requested by the prospective Bidders. The requisition of further Pre-Bid Conference from the prospective Bidders should be received by Tender Committee not later than 14th February 2020 at 14:00 WIB. The Employer will also arrange a site visit on the same date as the Pre-Bid Conference, if requested by the prospective Bidders.
8. The provisions in the Instructions to Bidders (ITB) and in the General Conditions of Contract (GCC), are the provisions of the Standard Bidding Documents (SBD) under Japanese ODA Loans for “Design Build” published by JICA in July 2015.
9. Bids must be delivered by way of submission to the MRTJ’s Office address provided below before or on the 5th June 2020 at 14:00 WIB and it must be accompanied by a Bid Security of Six Hundred Million Japanese Yen (JPY 600,000,000) per Contract Package. In the event, a combined bid for CP202 and CP203 is submitted, an independent Bid Security specific to the Contract Package shall be provided by the Bidder, in the same amount and currency as stated above.
10. Bids will be opened in the presence of the Bidders’ representatives who choose to attend on the 5th June 2020 at 14:30 WIB at the office of MRTJ below-mentioned.
